General Scope

User privacy is important to Innova Control Systems (hereinafter referred to as “Innova”), which is committed to adopting the necessary technical and organizational measures, according to the appropriate level of security, for the collected data.

Through this website, personal data is not collected from users without their knowledge, nor is it transferred to third parties. When we need to obtain information from you, we will always ask you to provide it voluntarily and explicitly.

Controller

In the context of this Privacy Policy, Innova Control Systems defines the following:

  • Customer: any entity that contracts or acquires our services
  • User: any visitor to this website, as well as other sites and microsites that mention this policy and/or subscribers to our electronic content list (Newsletter).

The personal data collected by Innova Control Systems through the existing forms, in digital and/or physical format, or other means such as subscriptions to our electronic newsletters, will be entered into automated personal data files under the responsibility of:

Purpose

The data collected by Innova Control Systems is intended for communication with Customers and Users, processing information requests, statistical analysis, as well as for corporate and/or commercial communications purposes (sending product and service information, price lists, invitations to fairs and events, notices, technical notes, and commercial offers).

Innova Control Systems will treat the data confidentially and solely for the purpose of providing the requested services, with all the legal and security guarantees imposed by the current Spanish and European regulations on the protection of personal data on the Internet. Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (GDPR), Organic Law 15/1999 of 13 December on the Protection of Personal Data (LOPD), and Law 34/2002 of 11 July on Information Society Services and Electronic Commerce (LSSI-CE).

Personal data of Innova Control Systems’ customers will be retained for the duration of the commercial relationship between both parties or until the customer requests rectification or cancellation.

Personal data provided for the purpose of our email content distribution list will be stored until it is no longer in use. In this case, Customers and Users can cancel their subscription to alerts at any time through the cancellation option provided in the Newsletters.

Furthermore, Innova Control Systems will cancel or rectify data when it is inaccurate, incomplete, or no longer necessary for the purposes of processing, in accordance with the provisions of Regulation (EU) 2016/679 (GDPR).

Legitimization

The legal basis for the processing of personal data depends on the purpose for which it has been collected.

In the case of users who have registered through the website form to download technical information, the legal basis will be Innova’s legitimate interest (Art. 6.1.f) GDPR) in responding to the requests made by users.

Furthermore, Innova will be legitimized based on its legitimate interest (Art. 6.1.f) GDPR) to send commercial information to those customers with whom it has a previous contractual relationship, provided that they have not objected, in accordance with Article 21.2 of the LSSI.

The sending of commercial information will be based on the consent (6.1.a) GDPR) given by users for those with whom there is no previous contractual relationship.

Recipients and data transfer to third parties

Innova Control Systems will not disclose personal data of its Customers and Users to third parties without their consent, except (1) when necessary for collaborators, employees, suppliers, or business partners of Innova Control Systems in order to provide a product or service or perform a function on behalf of Innova Control Systems, or (2) when required or permitted by law.

For the sending of electronic newsletters (Newsletters), Innova Control Systems uses an online marketing tool whose manufacturer complies with the GDPR (EU) 2016/679, as reflected in the agreement signed between the two companies.

There is an international transfer of data to the United States of America as a result of the commercial relationship with the online marketing service provider. This transfer complies with the necessary security guarantees by using the standard contractual clauses approved by the EU.

Acceptance of our privacy policy implies knowledge that your data will be transferred and securely stored on the servers of the company that provides online marketing services.

User Rights

In accordance with the Personal Data Protection Law (GDPR), the User may revoke the consent given and may exercise the rights of access, rectification, erasure, objection, and portability, which are recognized by the data controller.

Data updates should be communicated by the user themselves via email to dpo@innovagroupbcn.com or to the address of Innova Control Systems at Joaquim Mir, 55 08100 Mollet del Valles – Barcelona (Spain), properly identifying themselves and clearly indicating the specific right they wish to exercise.

This privacy policy does not apply to these websites and email addresses.

If the user accesses another website from a link available on the website, microsites, and social platforms of Innova Control Systems and provides personal data on that site, the processing of the data will be subject to the privacy statement of that website.

Website visitors can download and extract any location data from images on the website.
